Connecticut’s.02% BAC Threshold for Underage Drivers

Connecticut General Statutes § 14-227g applies a lower blood alcohol concentration (BAC) threshold to drivers under 21. An underage driver can face operating under the influence consequences at a BAC of.02% or higher, while the threshold for drivers age 21 and older is.08%. A result below the adult limit therefore doesn’t prevent an underage OUI or DUI case.

An elevated result can also lead to an administrative per se suspension. The DMV imposes this suspension based on the test result rather than a criminal conviction.

For a test result at or above the.02% threshold, Connecticut imposes a 45-day license suspension followed by an ignition interlock device requirement of:

• First offense: One year
• Second offense: Two years
• Third or subsequent offense: Three years

Immediate Rules for Drivers Ages 16 & 17

When a 16- or 17-year-old is arrested following allegations of driving under the influence or a test result at or above the underage threshold, the officer must seize the driver’s license for 48 hours and have the vehicle removed. These actions are distinct from any later DMV suspension or court result.

After the 48-hour period, the young driver must appear in person before the license can be returned. Unless the minor is emancipated, a parent or legal guardian must also appear and sign a written parental acknowledgement.

Connecticut’s implied-consent law treats anyone who drives as having consented to a chemical test for alcohol or drugs under the circumstances established by law. For a minor, the law also treats a parent or guardian as having given consent. Testing decisions and alleged refusals can become important issues in both proceedings.

Potential Consequences & Connecticut’s Intervention Program

A criminal charge isn’t a conviction, but the resolution of an underage OUI case can affect the driver’s record and driving privileges. College or financial-aid decisions, employment screening, and professional licensing consequences depend on the rules of the particular institution, employer, or licensing authority.

A young driver charged with DUI may apply to the court for Connecticut’s Pretrial Impaired Driving Intervention Program if eligible. Qualifying first-time offenders who successfully complete the program may obtain dismissal of the pending charge. Admission and dismissal aren’t automatic.
